SPECIAL EDUCATION LAW
The Individuals with Disabilities Education Act, or IDEA, ensures:
“that all children with disabilities recieve a free appropriate public education (FAPE) that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living.”
WHAT IS SPECIAL EDUCATION?
Special education means instruction provided at no cost to the parent that is specially designed to meet the unique needs of a disabled child.
A child is eligible to receive special education services if he or she has a qualifying disability and because of that disability needs special education and related services.
As a parent, you are your child’s voice in these matters. You have the right:
- To request an evaluation because your child’s educational needs are not being addressed by the school
- To request an independent educational evaluation if you disagree with the school’s evaluation
- To participate meaningfully in the development of an Individualized Education Program (IEP) that addresses your child’s unique needs
- To challenge a placement decision by the school
